Last week, the 2nd Circuit came out with a ruling that was not only terrible, but had many in the 2A sphere all worked up. Washington Gun Law President, William Kirk, discusses the ruling in Calce v. New York City, where the 2nd Circuit has upheld New York’s ban on stun guns and tasers. But many in the 2A sphere were decrying that the 2nd Circuit had violated the Supreme Court’s holdings in Caetano v. Masachusetts. But is that really true? Did anyone actually read Caetano to see what that very limited per curium ruling said? That’s what we discuss today, and how everybody is getting this wrong.
