Well, we thought the Pistol Brace Rule was dead, but it appears to be the rule that just can’t be killed. Case in point, the matter that we discuss today, United States v. Taranto. Washington Gun Law President, William Kirk, goes through the Government’s pleadings to deciper that the pistol brace rule is alive and well in this matter. Here the ATF is claiming that although they have used every single criteria in the now defunct rule, they have not actually used the rule and for that reason, the felony prosecution for possession of a short barrel rifle should continue.
